The Government approves the Procedure for conducting economic and statistical monitoring of economic entities included in the State Register of economic entities that occupy a dominant position in the Kyrgyz commodity markets

On August 15, 2019, the Resolution of the Government of the Kyrgyz Republic dated August 7, 2019 No. 404 “On approval of the Procedure for conducting economic and statistical monitoring of economic entities included in the State Register of economic entities that occupy a dominant position in the commodity markets of the Kyrgyz Republic” was published.

In order to implement Article 4 of the Law of the Kyrgyz Republic “On Competition”, in accordance with Articles 10 and 17 of the Constitutional Law of the Kyrgyz Republic “On the Government of the Kyrgyz Republic”, the Government of the Kyrgyz Republic decided:

1. To approve the Procedure for conducting economic and statistical monitoring of business entities included in the State Register of business entities that occupy a dominant position in the commodity markets of the Kyrgyz Republic, according to the annex.

2. Recognize the Resolution of the Government of the Kyrgyz Republic “On approval of the Procedure for conducting economic and statistical monitoring of economic entities included in the State Register of economic entities that occupy a dominant position in the commodity markets of the Kyrgyz Republic” dated August 23, 2018 No. 386.

3. This resolution shall enter into force after fifteen days from the date of official publication.

Amendments to the legislation in the field of protection of bank deposits made

On August 14, 2019, President of the Kyrgyz Republic Sooronbai Jeenbekov signed the Law of the Kyrgyz Republic “On Amending the Law of the Kyrgyz Republic “On the Protection of Bank Deposits”.

The law was adopted by the Jogorku Kenesh of the Kyrgyz Republic on June 26, 2019.

The law is aimed at creating legal norms for the system of compulsory protection of housing and savings deposits of participants in the system of contract housing savings.

This Law proposes amendments aimed at creating a legal mechanism to include the right to accept housing and savings deposits in national currency and provision of housing loans for housing and savings credit companies licensed by the National Bank of the Kyrgyz Republic.

The Economy Ministry submits for public discussion a bill on amendments to the Code of Violations

Since August 14, 2019, the Ministry of Economy of the Kyrgyz Republic submits for public discussion the draft Law of the Kyrgyz Republic “On Amendments to the Code of the Kyrgyz Republic on Violations” and the draft resolution of the Government of the Kyrgyz Republic “On Draft Law of the Kyrgyz Republic “On Amendments to the Code of the Kyrgyz Republic on violations."

The draft law was developed in order to establish liability measures for violation of tax legislation in order to bring it into line with the current legislation of the Kyrgyz Republic in the field of regulation of tax legal relations.

In accordance with Articles 50 and 51 of the Tax Code of the Kyrgyz Republic, tax authorities exercise control over compliance with tax laws and, if violations are detected, hold violators accountable.

The Code of the Kyrgyz Republic on violations does not provide for liability for certain violations in the field of taxation, which were previously provided for by the Code of the Kyrgyz Republic on administrative responsibility.

The absence of norms providing for liability complicates the work of tax authorities in the course of control.

Justice Ministry submits a bill on advocacy for public discussion

Since August 13, 2019, the Ministry of Justice of the Kyrgyz Republic submits for public discussion the draft Law of the Kyrgyz Republic “On Amending the Law of the Kyrgyz Republic “On the Advocacy of the Kyrgyz Republic” and the draft resolution of the Government of the Kyrgyz Republic “On the draft Law of the Kyrgyz Republic “On Amending to the Law of the Kyrgyz Republic “On the Advocacy of the Kyrgyz Republic.”

Economy Ministry submits a draft NLA for public discussion

Since August 13, 2019, the Ministry of Economy of the Kyrgyz Republic submits for public discussion a draft resolution of the Government of the Kyrgyz Republic on the procedure for issuing an electronic permit document (license / conclusion / permit) for export / import / transit of goods included in the Unified List of Goods to which non-tariff measures apply regulation in trade with third countries on the single window principle.

Ministry of Justice submits for public discussion a bill on amending the Code on Violations

Since August 13, 2019, the Ministry of Justice of the Kyrgyz Republic submits for public discussion the draft Law of the Kyrgyz Republic “On Amending the Code of the Kyrgyz Republic on Violations” and the draft resolution of the Government of the Kyrgyz Republic “On the Draft Law of the Kyrgyz Republic “On Amending the Code of the Kyrgyz Republic on Violations."

The purpose and objective of the bill is to eliminate gaps in the Code of the Kyrgyz Republic on Violations by amending the liability of legal entities and their branches (representative offices) for violations of the requirements of the Law of the Kyrgyz Republic “On state registration of legal entities, branches (representative offices)”.

In order to fill the gaps in the legislation, this draft law proposes to amend the code.

It is proposed to supplement the code with article 2951, which provides for liability for legal entities, their branches (representative offices) to carry out activities without appropriate state re-registration in the manner and terms established by the legislation of the Kyrgyz Republic.

The Code provides liability only for individuals and legal entities, while the responsibility of branches and representative offices as structural units of legal entities that do not have the status of a legal entity is not provided.
