A bill on amendments to the Labor Code regarding the establishment of a limitation period for the recovery of wages submitted for public discussion

Since February 17, 2020, the draft Law of the Kyrgyz Republic “On Amendments and Additions to Some Legislative Acts of the Kyrgyz Republic” has been submitted for public discussion.

The draft law has been developed in order to harmonize the norms of labor legislation of the Kyrgyz Republic and the Law of the Kyrgyz Republic “On ensuring timely payment of wages, pensions, benefits and other social benefits” and to balance the rights and interests of the employee and employer.

The draft law initiates amendments and addenda to the Labor Code of the Kyrgyz Republic regarding the establishment of a limitation period for collecting wages, the exclusion of 0.5% of the unpaid amount of wages to the employee upon dismissal; the Law of the Kyrgyz Republic "On ensuring the timely issuance of wages, pensions, benefits and other social benefits" regarding the exclusion of interest for the delay in the issuance of wages, pensions, benefits and other social benefits in the amount of 0.15 percent of the unpaid amount until the actual day calculation

A bill on amendments to the Law “On counteracting the financing of terrorist activities and the legalization (laundering) of criminal proceeds” submitted for public discussion

Since February 17, 2020, the draft Law of the Kyrgyz Republic “On Amending the Law of the Kyrgyz Republic “On Countering the Financing of Terrorist Activities and the Legalization (Laundering) of Criminal Incomes” has been submitted for public discussion. The Nonprofit Organization sector is seen by the FATF (Financial Action Task Force) as being particularly vulnerable to international standards for countering the financing of terrorism. According to the FATF, NGOs involved in the provision of services are most often used by terrorism movements for illegal purposes. The FATF specifically addresses this issue, requiring NGOs to know their particular attractiveness to terrorists to finance illegal activities, and, in this regard, their vulnerability, as well as the application of appropriate measures to counter this criminal activity. This is possible only in conditions of tight cooperation and interaction of NGOs and state bodies.

The draft law proposes to include legal entities and (or) individuals, with or without the formation of an independent legal entity, engaged in non-profit activities in the list of entities that implement measures to counteract the financing of terrorism activities and the legalization (laundering) of criminal proceeds as a non-financial category of persons.

The Ministry of Economy of the Kyrgyz Republic submits draft NLAs for public discussion

On February 18, 2020, the Ministry of Economy of the Kyrgyz Republic submitted for public discussion the draft Law of the Kyrgyz Republic “On Amending the Law of the Kyrgyz Republic “On Municipal Property Ownership” and the Draft Government Regulation “On the Draft Law of the Kyrgyz Republic “On Amending the Law of the Kyrgyz Republic “On Municipal Property on Property”.

It should be noted that the transfer of state property to municipal property was identified by the Working Group of the Security Council among the areas of corruption risk.

In order to exclude corruption risks when transferring state property to municipal property, the Ministry has developed a draft Law on introducing into the Law “On Municipal Property on Property” norms that provide the Government with the opportunity to transfer socially significant facilities to local authorities with the condition of preserving the intended purpose and the inadmissibility of alienation over time.

A bill on amendments to the Law of the Kyrgyz Republic “On Electronic Signature” submitted for public discussion

Since February 18, 2020, the draft Law of the Kyrgyz Republic “On Amending Certain Legislative Acts of the Kyrgyz Republic (the Laws of the Kyrgyz Republic “On Electronic Signatures”, “On Countering the Financing of Terrorism Activities and the Legalization (Laundering) of Criminal Incomes”, and “On Electric and Postal Service”)”.

The draft law was developed in connection with the improvement of regulation in the field of electronic signature and the creation of a single space of trust for electronic signatures.
