The draft law “On the prohibition of activities related to the geological study of mineral resources for the purpose of prospecting, exploration and development of uranium and thorium deposits in the Kyrgyz Republic” approved in the first reading

On June 27, the Parliament deputies considered the draft law “On the prohibition of activities related to the geological study of the subsoil for the purpose of prospecting, exploration and development of uranium and thorium deposits in the Kyrgyz Republic” in the first reading.

According to MP Almambet Shykmamatov, the bill provides for the prohibition of activities related to exploration and development of uranium and thorium deposits in the Kyrgyz Republic. The validity of previously issued licenses for geological exploration and development of uranium deposits will be terminated from the moment this Law enters into force. The Government was instructed to take measures to ensure environmental safety, prevent threats to the life or health of people working or living in the zone of influence of the works related to the use of subsurface resources in geological prospecting, exploration or development of uranium and thorium deposits in accordance with the legislation of the Kyrgyz Republic.

Amendments to the Law on Public Procurement

On June 26, 2019, President of the Kyrgyz Republic Sooronbai Jeenbekov signed the Law of the Kyrgyz Republic “On Amendments to the Law of the Kyrgyz Republic “On Public Procurement.”

The law was adopted by the Jogorku Kenesh of the Kyrgyz Republic on June 20, 2019.

In order to improve the legal regulation of relations arising during the implementation of public procurement, the adopted Law introduces several important changes and amendments to the Law of the Kyrgyz Republic of April 3, 2015 No. 72 “On Public Procurement”.

Parliament considers the third reading of the draft law “On Amendments to the Law of the Kyrgyz Republic “On Accumulative Pension Funds in the Kyrgyz Republic”

On June 26, the deputies of the Jogorku Kenesh reviewed the draft law “On Amendments to the Law of the Kyrgyz Republic “On Accumulative Pension Funds in the Kyrgyz Republic” in the third reading.

The draft law is aimed at creating new accumulative pension funds in the form of joint-stock companies; introduction of corporate and professional pension funds in the Kyrgyz Republic; the implementation of paragraphs 22 and 26 of the plan of measures for the implementation of the Pension System Development Concept of the Kyrgyz Republic, approved by the Government of the Kyrgyz Republic dated November 24, 2014 No. 670; development of the market of accumulative pension funds by improving the legislation of the Kyrgyz Republic in the sphere of accumulative pension funds.

The Fund and its branch (representative office) is considered to be created from the moment of state registration with the judicial authorities of the Kyrgyz Republic. The founders and shareholders of the fund may be legal entities and individuals – residents of the Kyrgyz Republic.

Parliament adopts amendments to the law on the protection of deposits

On June 26, 2019, the Parliament deputies approved the third reading of the draft law “On Amendments to the Law of the Kyrgyz Republic “On Protection of Bank Deposits.”

The draft law is aimed at creating legal norms for the activity of the system of mandatory protection of housing savings deposits (deposits) of participants in the contract housing savings system.

The deposit protection system is aimed at protecting participants in the contract housing savings system upon the occurrence of a warranty case by providing compensation in the amount and methods provided for in the Law on the Protection of Bank Deposits, as well as promoting the stability of the financial system as a whole.

The contract housing savings mechanism consists of two stages. At the first cumulative stage, the initial amount is collected through monthly contributions. At the second stage, a participant in the contract housing savings system receives an accumulated amount, a contribution fee and a loan. As a result, the the participants will be able to purchase or build housing.

A draft law aimed at solving problems in construction was sent to a vote

On June 27, the deputies of the Jogorku Kenesh considered the draft Law of the Kyrgyz Republic “On introducing amendments to some legislative acts of the Kyrgyz Republic in the field of construction (to the Law of the Kyrgyz Republic “On Urban Planning and Architecture of the Kyrgyz Republic”, to the Housing Code of the Kyrgyz Republic, and to the Land Code of the Kyrgyz Republic)” in the first reading.

MP Tynchtykbek Konushbaev, one of the bill initiators, explained that the bill is aimed at solving problems in the construction industry, timely completion and subsequent implementation of construction projects.

Currently, obtaining permits requires significant time costs, and the implementation of construction projects is delayed and the corresponding facilities are not put into operation in a timely manner.

“The long period of consideration of the documents submitted to the state agency inevitably leads to an increase in the cost of construction, to the breakdown of contracts between the construction organization and building materials trade organizations, sub-contractors, and partners. The draft law is aimed at solving these problems. As a result of the discussion, the draft law was sent to the vote in the first reading.
