A draft law regulating the activities of remote workers submitted for public discussion

On May 4, 2020, the Ministry of Labor and Social Development of the Kyrgyz Republic submitted for public discussion a draft Law of the Kyrgyz Republic “On Amending the Labor Code of the Kyrgyz Republic” and a draft resolution of the Government of the Kyrgyz Republic “On a draft Law of the Kyrgyz Republic “On Amending the Labor Code of the Kyrgyz Republic”.

The bill was developed to regulate the employee’s remote work at his home.

The current provisions regulate the situation in which the employee fulfills duties related to the production of consumer and craft goods from materials and using tools and mechanisms allocated by the employer or acquired by the homeworker at his own expense. Thus, these norms cannot be applicable for the regulation of labor of various categories of workers.

With the consolidation of new standards in labor legislation aimed at regulating remote workers, there will be a legal opportunity to organize the remote work of an employee at his home.

From May 6, 2020, the draft constitutional Law of the Kyrgyz Republic “On Amending the Constitutional Law of the Kyrgyz Republic “On the Election of the President of the Kyrgyz Republic and Deputies of the Jogorku Kenesh of the Kyrgyz Republic” фыs submitted for public discussion.

The purpose of this bill is to switch from one type of proportional election system to another, namely, from a closed party list to an open party list.

The bill will solve the problem of enabling the voter to choose both a political party and a specific person in the list of candidates, as well as candidates to work for the party and for themselves, creating conditions for their personality and certain independence.

The statement substantiating the bill indicates that 42% of the 120 MPs are representatives of business circles.

The Government of the Kyrgyz Republic recognizes the situation against the COVID-19 spread in the territory of the Kyrgyz Republic due to force majeure

The Government adopted a resolution of May 8, 2020 No. 241 On Measures for the Implementation of the Law of the Kyrgyz Republic “On Amending Certain Legislative Acts of the Kyrgyz Republic on the Stabilization of the Socio-Economic Situation in Connection with Force Majeure.”

In order to implement the Law of the Kyrgyz Republic “On Amending Certain Legislative Acts of the Kyrgyz Republic on the Stabilization of the Socio-Economic Situation Due to Force Majeure”, in accordance with Articles 10 and 17 of the Constitutional Law of the Kyrgyz Republic “On the Government of the Kyrgyz Republic”, the Government of the Kyrgyz Republic decides to recognize the situation against the spread of COVID-19 infection in the territory of the Kyrgyz Republic due to force majeure, in order to support the affected subjects of the Kyrgyz Republic on tax, customs, social and non-tax payments.

The Government of the Kyrgyz Republic introduces quarantine in the cities of Bishkek, Osh and a number of regions of the country

In order to prevent the further spread of coronavirus infection and ensure the sanitary and epidemiological well-being of the population, taking into account the decision of the emergency anti-epidemic commission under the Government of the Kyrgyz Republic dated May 8, 2020 No. 2, in accordance with article 21 of the Law of the Kyrgyz Republic “On Public Health”, Articles 10 and 17 of the Constitutional Law of the Kyrgyz Republic “On the Government of the Kyrgyz Republic”:

Introduce restrictive measures (quarantine) from May 11, 2020 for the period until special order in the cities of Bishkek, Osh, At-Bashy district of the Naryn oblast, and the Kanysh-Kya local government of the Chatkal district of the Jalal-Abad oblast of the Kyrgyz Republic.
