Business Kenesh proposes to finalize the "anti-smoking" bill taking into account the IBC comments

A meeting of the Business and Entrepreneurship Development Council (Business Kenesh) chaired by Speaker Dastanbek Jumabekov took place in Bishkek on November 12.

Council members, representatives of the government, public organizations and the business community participated in discussion of several bills.

The meeting participants considered the draft law “On Amending the Law of the Kyrgyz Republic “On the Procedure for Conducting Inspections of Entrepreneurship Entities”. Jumabekov stressed that creating the necessary conditions for businesses is a priority goal for the state.

“Therefore, everything should be within the law. The proposed changes should be adopted only after careful study and wide discussion,” he said.

The issue of improving the pre-trial and judicial stages of the consideration of tax disputes was raised. According to the Chairperson of the Chamber of Tax Advisers of the Kyrgyz Republic Tatyana Kim, in some cases, the courts considered such issues for a very long time. It was proposed to create a separate institution for the consideration of tax disputes with the involvement of independent experts.

During the discussion, the participants spoke about the need to develop a package of bills to ensure the legitimacy of decisions taken by appeal and judicial institutions. On these issues, it was decided to create a working group.

Daniyar Mederov, Deputy Executive Director of the International Business Council, voiced the opinion of the business community on the draft Law of the Kyrgyz Republic “On protecting the health of citizens from the consequences of tobacco consumption and the effects of surrounding tobacco smoke (aerosol)”. Undoubtedly, the business advocates for the protection of public health.

“However, we are convinced that the measures proposed by the bill will have the opposite effect. The price of tobacco products will increase significantly, the flow of cheaper smuggled and counterfeit cigarettes will increase, and the consumers will suffer from poor-quality products. In this case, the state budget will lose a significant amount of tax revenue. Thus, the goals of the draft law regarding the public health will not be achieved, and the legal market will suffer significantly. ”

Following the discussion, the group of bill initiators was entrusted to renew the regulatory impact analysis of the bill with the participation of business associations, as well as to consider the comments and suggestions of business and government to eliminate contradictions to the national legislation and the regulatory framework of the Eurasian Economic Union.
